Welcome to Elect Electric’s virtual service call feature, provided through our website at electelectric.com (the “Website”). By booking, accessing, or using our virtual electrical consultations (the “Services”), you agree to be bound by these Terms of Use (the “Terms”). If you do not agree to these Terms, please do not use the Services. Elect Electric, based in San Luis Obispo County and Santa Maria, CA, reserves the right to update these Terms at any time, with changes posted on the Website.

1. Description of Services

Elect Electric offers virtual service calls via Zoom for electrical troubleshooting, DIY guidance, and electrification planning (e.g., EV charger or wiring advice). Each session is priced at $75 per 15-minute increment, with options for pre-booked multi-session bundles or in-call extensions ($75 per additional 15-minute increment). The Services are available to clients in San Luis Obispo County, Santa Maria, and anywhere in the United States, conducted using a smartphone or computer with a camera and stable internet connection.

2. Eligibility

To use the Services, you must be at least 18 years old and have the legal capacity to enter into contracts. You agree to provide accurate information during booking, including payment details and contact information. Elect Electric reserves the right to refuse service to anyone who violates these Terms or misuses the Services.

3. Booking and Payment

  • Booking: Virtual service calls are booked through the Website using Wix Bookings. You must select a time slot, agree to these Terms, and provide payment upfront for single sessions ($75 per 15-minute session) or bundles.

  • Extensions: If you choose to extend a session during the call, additional 15-minute increments ($75 each) will be invoiced in-call via Wix Invoices, payment link or charged to your card on file, as agreed during booking.

  • Payment: Payments are processed securely through Wix Payments or other designated processors (e.g., Stripe). You are responsible for all applicable taxes and fees.

  • Currency: All prices are in US dollars (USD).

4. Cancellation and No-Refund Policy

  • Cancellations More Than 24 Hours in Advance: You may cancel or reschedule a virtual service call more than 24 hours before the scheduled start time for a full refund or to reschedule at no cost.

  • Cancellations Within 24 Hours or No-Shows: Cancellations or rescheduling requests within 24 hours of the scheduled start time, or failure to attend the session (no-show), will result in a full charge of $75 per booked 15-minute session or the full bundle price, with no refunds.

  • Exceptions: Elect Electric may waive the no-refund policy in exceptional circumstances (e.g., technical issues on our end), at our sole discretion.

5. Scope of Services

  • What We Provide: Virtual service calls offer professional advice for:

    • Initial troubleshooting of electrical issues (e.g., tripped breakers, flickering lights).

    • Basic DIY guidance for safe, minor repairs (e.g., replacing a switch) for qualified individuals.

    • Electrification planning (e.g., EV charger or solar wiring requirements).

    • Brief code compliance reviews (e.g., NEC, California Electrical Code).

  • What We Do Not Provide: The Services do not include:

    • Physical repairs or modifications to electrical systems.

    • Advice for unqualified individuals to perform hazardous tasks (e.g., rewiring circuits, panel work).

    • Final permitting or inspections required by local authorities (e.g., San Luis Obispo County).

    • Comprehensive resolution of complex projects in a single 15-minute session (multiple sessions or in-person service may be needed).

  • Client Responsibilities: You must provide clear visibility of the issue (e.g., breaker panel, wiring) via Zoom, ensure a stable internet connection, and follow safety instructions. Elect Electric is not responsible for outcomes of DIY repairs or client actions based on our advice.

6. Safety and Liability Disclaimer

Electrical work is inherently dangerous. Only individuals with appropriate qualifications and experience should attempt electrical repairs. Elect Electric provides guidance for informational purposes only and is not liable for any injuries, damages, or losses resulting from your use of the Services, DIY repairs, or failure to follow our recommendations. If a task is deemed unsafe or complex, we will advise seeking in-person professional service. You assume all risks associated with acting on our advice.

7. Intellectual Property

All content on the Website and provided during virtual service calls (e.g., advice, diagrams, recommendations) is the property of Elect Electric or its licensors. You may not reproduce, distribute, or use this content for commercial purposes without our written consent. You may use our advice solely for personal, non-commercial purposes related to your electrical project.

8. Privacy

Your personal information is collected, used, and protected in accordance with our Privacy Policy https://www.electelectric.com/privacy-policy. We comply with the California Consumer Privacy Act (CCPA) and other applicable laws. By using the Services, you consent to the use of your data (e.g., name, payment details, Zoom video) for booking, payment, and service delivery.

9. Limitation of Liability

To the fullest extent permitted by law, Elect Electric, its owners, employees, and agents are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the Services, including but not limited to property damage, personal injury, or financial loss. Our total liability for any claim related to the Services is limited to the amount you paid for the session(s).

10. Indemnification

You agree to indemnify and hold Elect Electric harmless from any claims, damages, or liabilities arising from your use of the Services, violation of these Terms, or actions taken based on our advice (e.g., DIY repairs).

11. Termination

Elect Electric may terminate or suspend your access to the Services at any time for violating these Terms, misusing the Services, or failing to pay for sessions or extensions. You may stop using the Services at any time, subject to the cancellation policy.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from the Services will be resolved through binding arbitration in San Luis Obispo County, CA, in accordance with the rules of the American Arbitration Association, except where prohibited by law. You waive the right to participate in class action lawsuits.

 

13. Force Majeure

Elect Electric is not liable for delays or failures to provide the Services due to events beyond our control, such as internet outages, natural disasters, or technical failures (e.g., Zoom downtime).

15. Miscellaneous

  • Entire Agreement: These Terms, along with our Cancellation Policy and Privacy Policy, constitute the entire agreement between you and Elect Electric regarding the Services.

  • Severability: If any part of these Terms is found unenforceable, the remaining provisions will remain in effect.

  • Waiver: Our failure to enforce any provision of these Terms does not waive our right to enforce it later.
