Terms of Service for Elect Electric

Elect Services Inc., doing business as Elect Electric (“We,” “Us,” “Our,” or the “Company”), located at 9800 El Camino Real # 6036, Atascadero, CA 93423, provides in-person electrical services, virtual consultations, and maintenance plans through www.electelectric.com (the “Website”) and related services (collectively, the “Services”). These Terms of Service (“Terms”) govern your access to and use of the Services, with primary focus on in-person electrical service and repair at your home or business. 1. Definitions

Device: Computer, smartphone, or tablet used to access the Website or virtual consultations.

Maintenance Plan: Subscription-based electrical maintenance (e.g., inspections, priority repairs).

Services: In-person electrical service and repair, virtual consultations via Zoom, maintenance plans, and Website access.

User/Client: Individual or entity engaging the Services, at least 18 years old.

2. Acceptance of Terms
By using the Services, you agree to these Terms, our Privacy Policy (https://www.electelectric.com/privacy-policy), Booking Policy, and any linked policies. You confirm you are 18 or older and have legal capacity to enter contracts. The Services are not for users under 18.

3. Description of Services

In-Person Electrical Services: Electrical installations, repairs, and upgrades (e.g., wiring, panels, EV chargers, lighting) at homes or businesses in San Luis Obispo County and Santa Maria, CA. Pricing, scope, and timelines are provided in written quotes or agreements.

Virtual Consultations: Zoom-based sessions for troubleshooting, DIY guidance (for qualified individuals), and electrification planning at $75/15-minute session, with bundles or in-call extensions ($75/15 min, invoiced in-call), booked via Wix Bookings, available nationwide.

Maintenance Plans: Subscription-based services (e.g., annual inspections, priority repairs), with pricing and terms at signup. Plans auto-renew unless canceled per Section 5.

4. In-Person Electrical Services

Quotes and Agreements: We provide written quotes for in-person work, detailing scope, pricing, and estimated timelines. Additional work requires your approval. Acceptance of a quote forms a binding agreement.

Property Access: You must provide safe, unobstructed access to the work area (e.g., clear hazards, secure pets). We are not liable for delays or damages due to inadequate access or unsafe conditions.

Client Responsibilities: Ensure the property meets code requirements (e.g., California Electrical Code) and provide necessary utilities (e.g., power, water). You are responsible for pre-existing defects or non-disclosed issues.

Workmanship Warranty: In-person work is warranted for 90 days from completion against defects in materials or installation, subject to normal use. We will repair or replace defective work at no cost, provided you notify us within 90 days. Exclusions include client misuse, third-party interference, or pre-existing conditions. No other warranties apply.

Permits and Inspections: We obtain required permits (e.g., San Luis Obispo County) unless otherwise agreed. You are responsible for related fees and ensuring property compliance with inspections.

5. Booking, Payment, and Maintenance Plans

In-Person Appointments: Schedule via phone, email, or Website. Deposits may be required per quote. Cancellations within 24 hours or no-shows may incur a $75 fee, non-refundable.

Virtual Consultations: Book via Wix Bookings, prepaying $75/15-minute session or bundle prices . Extensions ($75/15 min) are invoiced post-call. Cancellations more than 24 hours before are refundable; within 24 hours or no-shows incur the full fee, non-refundable, per our Booking Policy (#).

Maintenance Plans: Fees (e.g., monthly, annual) are charged per plan terms, auto-renewing until canceled 30 days before renewal via info@ElectElectric.com (mailto:info@ElectElectric.com) or 805-438-4357. No refunds for partial periods. On-site visits follow in-person service terms (Section 4).

Payment: Processed via Wix Payments, Stripe, check, or other methods. You cover taxes and fees (e.g., 2.9% + $0.30 per transaction). Late payments may incur fees or service suspension, with collection costs your responsibility.

Estimates: In-person service quotes are estimates. Additional costs (e.g., unforeseen repairs) require your approval.

6. User Responsibilities

Accurate Information: Provide true details for bookings, services, or plans (e.g., property condition, payment info).

Technical Requirements (Virtual): Ensure a Device with Zoom, stable internet, and lighting for virtual calls (e.g., to show wiring).

Safety Compliance: Follow safety instructions. Only qualified individuals should attempt electrical work. We may recommend in-person service for complex tasks.

Property Conditions (In-Person): Maintain a safe work environment, disclose known issues (e.g., faulty wiring), and comply with local codes.

Prohibited Conduct: Do not misuse Services (e.g., record Zoom calls without consent, obstruct work, engage in fraud).

7. Intellectual Property
Content, advice, designs, and plans (e.g., wiring schematics, maintenance schedules) are owned by Elect Services Inc. DBA Elect Electric or its licensors. Use for personal, non-commercial purposes only. Do not reproduce, distribute, or use commercially without written consent.

8. Disclaimers and Safety Warning

“AS IS” Basis: Services are provided “AS IS” without warranties, except the workmanship warranty in Section 4. We disclaim implied warranties (e.g., merchantability, fitness for purpose).

Electrical Safety: Electrical work is hazardous. In-person services and virtual consultations provide professional guidance only. We are not responsible for injuries, damages, or losses from your actions, reliance on advice, or property conditions. Only qualified individuals should attempt repairs.

Maintenance Plans: Services depend on property access and conditions. We are not liable for delays or issues beyond our control.

Accuracy: Advice may not suit all situations. Verify local codes (e.g., California Electrical Code).

9. Limitation of Liability
To the fullest extent permitted by law, Elect Services Inc. DBA Elect Electric, its affiliates, and providers are not liable for direct, indirect, incidental, or consequential damages (e.g., injury, property damage, lost profits) arising from the Services, including in-person work, virtual advice, or maintenance plans, even if advised of such damages. Our liability is limited to amounts paid for the Services (e.g., $75/session, service fees) or $100 if no payment was made. Some states may limit these exclusions, applying them to the maximum extent enforceable.

10. Indemnification
You agree to indemnify and hold harmless Elect Services Inc. DBA Elect Electric, its officers, employees, and agents from claims, damages, or liabilities arising from your use of the Services, violation of these Terms, property conditions, or actions based on our advice or work (e.g., DIY repairs, maintenance issues).

11. Termination
We may suspend or terminate your access to the Services, including maintenance plans or in-person work, without notice for violating these Terms, misusing Services, or non-payment. Termination ends your rights, with no refunds for unused periods.

12. Third-Party Services
Services use third-party platforms (e.g., Wix, Zoom, Stripe). We are not responsible for their content, privacy, or performance. Review their terms.

13. Governing Law and Dispute Resolution
These Terms are governed by California law, excluding conflict of law rules. Disputes will be resolved through binding arbitration in San Luis Obispo County, CA, per American Arbitration Association rules, except where prohibited. You waive class action rights. Attempt informal resolution first via

14. Force Majeure
We are not liable for delays or failures due to events beyond our control (e.g., power outages, natural disasters, Zoom downtime).

15. Changes to Terms
We may update these Terms, notifying material changes via email or Website notice 30 days in advance. Continued use after changes constitutes acceptance.

16. Severability and Waiver
If a provision is unenforceable, others remain in effect. Failure to enforce a right does not waive it.
